As a tenant, you may only terminate your rental contract early in three possible scenarios:
- Before the start of your contract: If you terminate less than 3 months before the start of your contract, you will have to pay a termination fee of 2 months. If you terminate earlier, you do not have to pay any fee.
- If you cease your studies: You officially terminate your rental by notifying the landlord and providing proof of deregistration from your educational institution. A notice period of 2 months will begin on the first day of the following month. If a new tenant is found during the notice period, the existing rental contract will be terminated at the moment the new contract comes into effect. The landlord cannot demand any termination fee from the original tenant in this case.
Note: This arrangement does not apply when you graduate or when the academic year ends and you do not re-enroll. - In the event of the death of one of your parents or a person responsible for your maintenance.
Any issues? As a student of one of the higher education institutions in Antwerp, you can always rely on the housing service of your institution. They can mediate with the landlord and potentially help find another student to take over the room. The landlord must agree to this and is not obligated to do so.
